State v. Mr. G (DMC No. 18114) – Felony Aggravated Assault on a Child (with Knife) and Felony Child Abuse – Not Charged (Due to No Probable Cause) – Chandler Police Department Investigated (Case No. CH20XX-XXXX3)
Mr. G had a very contentious relationship with his ex-wife. They had a shared custody plan, that involved him traveling from Chandler into Fountain Hills almost every week. Occasionally, his ex-wife would interfere with the drop-off and pick-up. At one point prior to his scheduled visitation time over Easter, due to the animosity between the two of them, Mr. G had a Police Officer as a “Civil Standby” when he went by to pick up his 7-year-old son. He did not want any false allegations or problems with his ex-wife.
While he was at home for Easter, they had a very good time, and after the 7-year-old got home, he claimed that he was threatened with a knife by his dad. It was at that point Mr. G’s ex-wife contacted the Arizona Department of Child Services, and Mr. G and his new wife were interviewed at length. It was at that point that Mr. G secured the services of DM Cantor.
We then asked for copies of all Police Reports involving the allegation. We also had discovered that the 7-year-old had now admitted he had been lying about the allegation because he doesn’t like being around his dad. Unfortunately, Mr. G was upset, and told his son to pack up his things and go back to his mother, because he “didn’t want a liar in the household”. As he was out on the curb with the child, the Police arrived (because they were called by his ex-wife), and he was Arrested for a Misdemeanor Disorderly Conduct.
Ultimately, No Charges were brought regarding the Aggravated Assault on a Child with a Knife, or Felony Child Abuse. This determination was made by Detectives because there was “No Probable Cause” that this event actually occurred. Had Mr. G been Arrested, Charged and Convicted, he would have lost Custody and Visitation with his children. Instead, he now maintains a very productive relationship with all of his children.
