State v. Mr. G (DMC No. 17147) – Felony Child Molestation (11-year-old Minor/48-year-old Adult) Dangerous Crimes Against Children – Not Charged (Due to Admitted False Allegation) – Florence Police Department Investigated (Case No. F20XX-XXXXX7)
Mr. G lived in Casa Grande with his fiancé, who was a nurse for the Pinal County Sheriff’s Office Jail. She had an 11-year-old daughter, and Mr. G acted as a disciplinarian in the household. The girl had previous troubles, and had made two prior allegations against Mr. G claiming that he was “inappropriate” towards her and “touched her hip”. These allegations would always happen after she was upset at his strict rules.
Mr. G was getting ready to have them all move out of their current house. The girl had been demonstrating highly sexualized behavior, such as accessing an internet laptop in an unrestricted fashion to watch pornography. While Mr. G was in another state on a construction job, the girl accused him of watching pornography and masturbating in front of her. She also accused him of touching her. He received a call from his girlfriend and was informed that the Police had been contacted. That’s when he secured the services of DM Cantor.
Once we became involved with the case, we contacted the Lead Detective to inform him that we represented Mr. G. We also received a copy of the Police Report, which included interviews at the Child Advocacy Center in Queen Creek, Arizona. When the allegations occurred, Mr. G moved out of the household, and had no further contact with the 11-year-old who was making the allegations. We also provided a polygraph examination, in which Mr. G “passed”, and was shown not to have touched the girl. We also provided other information to the Detectives showing that she had made false allegations in the past.
The Detectives then re-interviewed the mother, and others who knew the girl. Eventually, the girl admitted that she had made up the lie, because she did not want to live with Mr. G. It was at this time that the case was “Closed” pending further investigation. Had Mr. G been Charged and Convicted of this crime, he could have spent the Rest of his Life in Prison. Instead, he has No Criminal Record and is a free man today.
