State v. Mr. G (DMC No. 16857) – Felony Sexual Assault, and Felony Sexual Abuse (While on Felony Probation) – Not Charged – Maricopa County Sheriff’s Office Investigated (IR No. 20XX-XXXXX1)

Mr. G was on Probation for Felony Aggravated DUI, and was working at a horse stable and horse rescue ranch in order to earn Community Service Hours for his Probation. He spent the night at the ranch with other ranch hands prior to the next day’s work. At some point, a 16-year-old ranch hand who had known Mr. G for over nine years, said she was awoken in the middle of the night and that Mr. G’s hand was in her pants touching her “private areas”. 

Mr. G was awoken the next morning by relatives of the alleged victim who began fighting with him. In addition, the Maricopa County Sheriff’s Office was called. Mr. G denied having any contact with the alleged victim, and he Invoked his Rights to Remain Silent. He then hired DM Cantor.

Upon our involvement, we contacted Maricopa County Sheriff’s Office and invoked, in writing, Mr. G’s Right to Remain Silent. We also got Mr. G into our office to do a Biography Memo and Timeline Memo of everything that occurred that day. Lastly, we spoke with Detectives and informed them that without any physical evidence, witnesses, or admissions, they would not have enough evidence to move forward on this particular case. Ultimately, the Maricopa County Sheriff’s Office “Closed the Investigation.” Had Mr. G had been convicted of these charges (while on Probation), he would have fallen into a “Category 2” designation, and could have spent over 20 years in Prison. In addition, we worked with his Probation Officer, and he was “Not Violated” from Probation.
