State v. Mr. G (DMC No. 16704) – DUI (.132 BAC) Only – Not Guilty/Partial Acquittal at Jury Trial – Apr 22, 2021 – Scottsdale City Court (Case No. TR2019-011376)
Mr. G had seen multiple Police lights and the road shut down near McCormick Parkway and Hayden in Scottsdale. He parked his car and walked over to see what was going on. Police were conducting an investigation on a traffic fatality, and the Police Aide that he spoke with told Mr. G that he could smell alcohol on him, and thought that he was impaired and asked if he could call a ride for Mr. G. Mr. G said he was fine and left the area.
After he left, the Police Aide had called for Officers to pull over Mr. G. Subsequently he was pulled over, and he was asked where he had been drinking. He said he was coming from the Oreganos at Scottsdale and Shea Road. He also refused to do any Preliminary Breath Test or Field Sobriety Tests, which resulted in him being arrested. At Jury Trial, the Jurors concluded that he was Not Guilty of Driving Under the Influence of alcohol. However, he was convicted of being above the .08 legal limit.
