State v. Mr. G (DMC No. 16316) – (3 Counts) Felony Child Molestation (Dangerous Crimes Against Children) 54-year-old alleged Molest of a 5-year-old, and (2 Counts) Public Sexual Indecency to a Minor – Not Charged/”Case Closed” – Phoenix Police Department Investigated (DR No. 20XX-XXXXXXX0), and New Mexico Department of Public Safety Investigated (DR No. 20XX-XXXX3)  

Mr. G was a Spanish speaker and was a naturalized citizen in the United States. Various family members had gotten together after one child had made accusations of Molest, and it generated three different Police Reports with the Phoenix Police Department, and one with the New Mexico Department of Public Safety. All of these claims involve three different Child Molestation allegations, along with two different Public Sexual Indecency to a Minor allegations. Specifically, three children stated they were fondled and Molested, and another two stated that Mr. G had exposed himself and masturbated in front of them. The alleged victim’s age ranges were from 5 years old to 12 years old.

After Phoenix Police Detective left a card for Mr. G, he contacted DM Cantor, and we began representing him. We immediately Invoked his Rights to Remain Silent, and requested all of the Police Reports. Even though Mr. G had not spoken with the Police, he had denied all of this from happening. We also pointed out to the Police that some of these allegations claim they were traveling back and forth in a car between New Mexico and Arizona when these incidents allegedly occurred. That created a “Jurisdictional Issue” that was almost impossible for the two Police Departments to reconcile. 

After meeting with the Detectives and explaining the issues that they had had, along with Mr. G’s denials, they agreed that they did not have evidence to move forward. We also presented evidence that various family members were upset at “Uncle G”, because he had stopped providing money to the rest of the family members. We pointed out that this is the motive for these family members to become upset and tell falsehoods. Ultimately, the case was “Closed”, and Mr. G has No Criminal Records. Had he been charged and convicted of all counts, he would have spent the rest of his Life in Prison.
