State v. Mr. F (DMC No. 18020) – Felony Fraudulent Schemes ($49,806), and Felony Theft – Reduced to Attempt and Probation (with Zero Days in Jail) – Maricopa County Superior Court (Case No. CR2021-002169)

Mr. F was a Peoria Police Officer who also served on a Peoria Police Officer’s Association as the Treasurer. During his tenure, he and the President were improperly using and taking funds by way of cash, checks and credit card charges. Some of these charges were to Apple, Amazon, Costco, motorsport/autopart stores, Men’s Warehouse, and gas stations. When the Board found out about this conduct, they ultimately had Mr. F terminated from both the Board and the Peoria Police Department. He was subsequently Indicted for Fraudulent Schemes and Theft. That’s when he secured the services of DM Cantor. 

Once we became involved, we had Mr. F immediately make a Restitution payment of $16,000 to the Peoria Police Officer’s Association, and we began putting together a Mitigation Package. In that Package, we showed that Mr. F was careless with the funds, misunderstood what was an appropriate charge, versus an inappropriate charge. Also, in the Mitigation Package we presented evidence of his age, prior good acts, his family contributions, his lack of prior bad acts, his acceptance of responsibility, and the opinions of family members. After conducting a Settlement Conference, the State agreed to Reduce the Charge to Attempt with Probation and Zero Days in Jail. After Mr. F was Sentenced, he quickly made Full Restitution, and performed admirably on Probation. Had Mr. F originally gone to Trial and been Convicted of the original Charges, he could have spent Years in Prison.
