State v. Mr. F (DMC No. 15610) – Felony Fraudulent Schemes ($500,000), Felony Vulnerable Adult Abuse, and Felony Theft – Not Charged/”Turned Down” by the Arizona Attorney General’s Office – Maricopa County Sheriff’s Office Investigated (IR No. 1XXXXX9)
Mr. F and another woman were private caregivers retained by an elderly couple in Rio Verde in order to care for them in the last several years of their lives. The husband had slipped and fell, and was under their care for several years when he eventually passed away. The wife then moved to another area of Rio Verde in order to downsize, and began distancing herself from other retirees who her and her husband were previously friends within the development. Several of the friends became concerned that Mr. F and the other caregiver were abusing the wife, and taking advantage of her financially. They had called the Police on numerous occasions, and when the Police would go out and visit with the elderly woman, she was in great health, and stated that she “simply didn’t like” the rest of the group, and wanted them to leave them alone. She also stated she was very happy with her caregivers.
It was at this time that Mr. F secured the services of DM Cantor. Shortly after the Police visit, a Private Attorney became involved and threatened a lawsuit against Mr. F and the other caregiver. We then coordinated with the elderly woman’s Estate Planning Attorney, and put together a detailed packet showing that she was not being abused, and she wanted to be left alone and not harassed anymore by these former neighbors. We eventually presented all of that evidence to the Arizona Attorney General’s Office, and they made the decision to “Turn Down” any Prosecution against Mr. F and the other caregiver. They made the determination that the $250,000 annual fee (paid each year for two years) was reasonable in order to have two full-time caregivers inside of the elderly woman’s house providing for her.
Lastly, we threatened Legal Action against the other neighbors for Harassment and Defamation. Ultimately, they left the elderly woman alone, and she was very happy to be taken care of by Mr. F and the other healthcare provider. Now Mr. F has No Criminal Record.
