State v. Mr. D (DMC No. 15838) – Federal Felony Sexual Exploitation of a Minor, Felony Luring of a Minor for Sexual Exploitation, and Felony Furnishing Harmful or Obscene Materials to a Minor – Not Charged/”Turned Down” by the Tucson United States Attorney’s Office – FBI Investigated
Mr. D was a 20-year-old male who was on the Autistic Spectrum. He met a 15-year-old girl on Tumblr, and they began “sexting” and sending nude images to each other. Eventually, the girl blocked Mr. D, and they had no further contact. Three years later, FBI agents showed up to his home to question him. They also seized his computers and phones. This is when DM Cantor was hired by Mr. D’s parents to represent him.
The first thing we did was contact the FBI Agent involved in the case, and we explained that Mr. D was on the Autism Spectrum. Even though he had admitted to the crime, he didn’t fully comprehend the activity he was engaged in. We then secured all of Mr. D’s prior medical records which contained his Autistic Diagnoses. We also provided proof that he was on Social Security Disability, due to his condition, and the fact he does have a driver’s license or drive a car (even though he was 23 at this time).
Ultimately, through conversations with the Assistant US Attorney for the District of Tucson, we were able to convince the Prosecutor to Not File Charges. Had Mr. D had been charged and convicted of these crimes, he could have spent Years Behind Bars.
