State v. Mr. D (DMC No. 15547) – Juvenile Felony Sexual Conduct with a Minor (13-year-old touching a 7-year-old Allegation) – Not Charged/Not Routed To Maricopa County Attorney’s Juvenile Division – Phoenix Police Department Investigated (DR No. 20XX-XXXXXXX8) 

Mr. D was a 13-year-old male who was accused of digitally penetrating his 7-year-old cousin. These allegations happened when the alleged victim was playing with her friend, got struck with a Nerf Gun bullet in her private area, and said it was okay for her friend to touch her private parts, saying “it’s okay because we are family”. The alleged victim’s overly protective parents immediately began questioning her, and she eventually said she was touched by her cousin “over 50 times”. 

This was claimed to have occurred at his brother’s high school graduation party, her fifth birthday party, and during a swim meet at the Anthem pool. The victim’s parents were convinced this was accurate because she was having UTI infections during the time that the swim meet was occurring. 

The Police were contacted, and the alleged victim was interviewed by a Forensic Expert at Child Help. She had also been placed into counseling prior to the Forensic Interview (which always taints the accuracy of a subsequent interview). It was during this time that DM Cantor was contacted and we became involved in the case. 

We immediately gathered all photos and text records of the corresponding times of the alleged Molest. We were able to show that Mr. D and the alleged victim were never alone together during these times. In addition, we found a school record where the alleged victim had stated that a man showed up at their school with a gun, and it turned out she was lying, and she was disciplined by the school for this. After contacting the Detectives and providing all this information, the decision was made to find the allegations “Unfounded”. The case was never forwarded to the Maricopa County Attorney’s Office, Juvenile Division for prosecution.
