State v. Mr. D (DMC No. 15545) – Felony Sexual Abuse (43-Year-Old Adult/13-Year-Old Minor) – Not Charged/”Case Inactivated” – Mesa Police Department Investigated (DR No. 20XX-XXXXXX1)

Mr. D was a 43-year-old male from Indiana who was in Phoenix to work for a week. He went over to visit his sister, had dinner and drank heavily, and then was invited to spend the night. At some point the next morning, his 14-year-old niece told her parents that Mr. D had come into her bedroom, kissed her on the lips, and had grabbed her breast. 

The family immediately confronted Mr. D, and had him leave the house. It was at this time that he secured the services of DM Cantor. Once we became involved, we found out that the Mesa Police Department had been contacted, and a Report had been filed. We immediately contacted the Detective, and sent over a “Trebus” Letter. 

In the meantime, Mr. D’s family in Indiana had been contacted and made aware of the situation. Through family members in Indiana, contact was made to family members in Mesa, and the entire family decided they did not want to proceed with Prosecution because they only wanted Mr. D to receive alcohol counseling. We informed the Detective of this development, and we also verified that Mr. D had No Prior Criminal History whatsoever, and at that point, the Detective made the decision to “Inactivate” the case, and he did Not Route it to the Maricopa County Attorney’s Office for Charging. Had the case been routed for Charging, had been Charged, and Mr. D Convicted, he could have spent well over 5 Years in Prison.
