State v. Mr. C (DMC No. 18295) – (4 Counts) Felony Embezzlement ($10,000), and Felony Fraudulent Schemes – Not Charged (Due to Civil Settlement) – Property Management Company Investigated:  

Mr. C worked for a local property management company in Phoenix, Arizona. As some point, a tenant who was in a building adjacent to the office that Mr. C worked out of needed additional parking spots. This was a hair salon, and they had many patrons coming in and out of their business. He agreed to lease 30 parking spots at the top of the parking garage, which was connected to the property management building. He was later accused by the management company of keeping the money that was paid for the parking spots.

Once he had been accused and was terminated from his job, he then secured the services of DM Cantor. We immediately contacted the property management group’s Attorney, and informed them that there were no actual records of any checks cashed by Mr. C. In addition, we pointed out that even if there was a side deal, the leasing of parking spaces could not be entered into the property management’s computer system, because there was no square footage or address associated with them. Due to these flaws in their theory of their case, we were able to negotiate the Civil Settlement in which Mr. C paid a nominal sum, and admitted no wrongdoing. Because this was resolved with a Civil Settlement, No Criminal Charges were ever brought against Mr. C.
