State v. Mr. C (DMC No. 18260) – (4 Counts) Felony Unlawful Disclosure of Images/Revenge Porn (Per ARS 13-1425.A) – Reduced to Probation (with Lowest Possible Sentence at Sentencing Hearing) and Zero Days in Jail and No Sex Offender Registration – Pima County Superior Court (Case No. CR2023-0707)
Mr. C had been in a relationship with a young woman for approximately four years. They were engaged to be married, but eventually their engagement was called off and they broke up. During the four years they were dating, they had numerous sexual encounters, in which they were videotaped and also had photographic pictures produced. All of this was done with both of their consent.
Approximately three years after they had broke up, the young lady received an anonymous email from a person stating that there were photos and images of her on various websites that involved nudity and sex. These sites included XHamster, Motherless, Mega, Porneeo, and 4Chan. In all there were 110 photographs and 16 videos. The woman immediately recognized that they were all from when she was dating Mr. C, and she filed an Order of Protection against Mr. C. In addition, she contacted the Tucson Police Department, and they began an Investigation. After they reached out to Mr. C, he then secured the services of DM Cantor.
The Detective had used IP tracers to determine that Mr. C was the person who posted the images. The Pima County Attorney’s Office then Indicted Mr. C on 4 Counts of Unlawful Disclosure of Image/Revenge Porn per ARS13-1425(A). The images were able to be taken down on the internet quickly by using the Spectra method, and by a company called NetReputation. This was all done by Mr. C.
Because the posting also included the young lady’s name, what University she went to, and her Degree, the Prosecutor was fairly upset and was seeking Jail time. At the Sentencing, we were able to convince the Judge to issue a Sentence that involved a low level of Probation, No Jail Time, and No Requirement to Register as a Sex Offender. If the Judge would have maxed out the Sentence, Mr. C could have spent 3.75 Years in Prison and have a Requirement to Register as a Sex Offender.
