State v. Mr. B was a war veteran who suffered from PTSD. In addition to medications, he would also use medical marijuana. At some point, his 12-year-old daughter discovered that he was using marijuana, and she became upset with him because he would “use drugs in the house”, and yet he had incredibly strict rules for her to abide by. Since Mr. B had divorced her biological mother, and he was now remarried, the girl wanted to live with her biological mother. After she went to school, she told two people and a Teacher that she had been Molested by her father. Her biological mother then picked her up, and would not return her to Mr. B. Mr. B was then contacted by Detectives who told him of the allegation. It was at this time he secured the services of DM Cantor. 

We immediately got the entire background regarding Mr. B’s daughter, and we also contacted the Detectives. The Detectives indicated there was a Forensic Interview held at the San Tan Valley Family Advocacy Center, and she had made two specific allegations. One was that several years back, Mr. B allegedly grabbed her vagina while giving her a hug; and the second allegation was that he snuck into her bedroom and had rubbed his penis on her private parts. She also made the claim that Mr. B had offered to buy her air pods if she would show him her vagina (i.e., the most recent allegation).

We then secured all texts that went back and forth between all parties involved. Mr. B’s wife also brought in their 5-year-old for a Forensic Interview, and he stated that he had never been touched inappropriately, and no harm was disclosed. Ultimately, we prepared a “Trebus/Bashir” Letter, and provided that to the Detective with all exculpatory information. At that time, the Detective made the decision to “Close” the Case, and No Charges were brought. At that point, Mr. B was then involved in a Custody Battle with his ex-wife. Ultimately, Mr. B has No Criminal Charges on his Record, and his Record is Clean.
