State v. Mr. B (DMC No. 17561) – Felony Sexual Exploitation of a Minor (5-year-old Minor/57-year-old Adult) Dangerous Crimes Against Children – Not Charged/”Unsubstantiated” by the Arizona Department of Child Safety – Phoenix Police Department Investigated (DR No. 20XX-XXXXXXXX1), Bakersfield, California Police Department Investigated; and Arizona Department of Child Safety Investigated (DCS No. 6XXXX6)
Mr. B was married and had three daughters who were age 23, 21, and 14 years old when criminal allegations were made against him. Prior to the allegations, he and his wife had gotten Divorced due to an extramarital affair that he had. The three daughters were upset with him, and did not want to move with him from Bakersfield, California to Phoenix, Arizona. After Mr. B had moved, he only had five visits with his daughters in the next couple of years. At one point, the middle daughter was having mental health issues and was having a “nervous breakdown”, and the mother moved her out to live with Mr. B.
After a short while of living with him, and her grandparents, she moved back to California. It was at that time, she made allegations of ongoing Sexual Abuse that lasted for more than ten years. These allegations were made to his ex-wife, and a Counselor/Pastor at the local Church. She was interviewed by Department of Child Safety at their facility, and it was disclosed that she had anorexia, and she had cut herself in the past. During the interview, she was rambling and somewhat incoherent. At one point, Phoenix Police Detective contacted Mr. B, and that’s when he secured the services of DM Cantor.
Once we were retained, we got copies of all the Police Reports and the DCS report. His mentally disturbed daughter was claiming that he had oral sex, vaginal sex, and anal sex with her numerous times over the years. She claimed this started when she was five years old. A recorded “Confrontation Call” had been conducted previously, in which they tried to secure admissions from Mr. B. He was outraged, and stated that none of that conduct had occurred.
We had him take a polygraph examination, in which he “passed”. We then put together a packet of information detailing all of his daughter’s prior mental struggles, and we included a copy of that polygraph. Once his “Trebus/Bashir” Letter was received, the Phoenix Police Detective closed his investigation, but forwarded all of documentation to the Bakersfield Police Department. Apparently, his daughter had also made allegations to the Bakersfield Police. They also chose Not to File Charges against Mr. B. Lastly, the Department of Child Services “Unsubstantiated” all of the allegations. Had Mr. B been originally Charged and Convicted of these crimes, he could have spent the Rest of his Life in Prison. Instead, he has No Criminal History.
