State v. Mr. B (DMC No. 16596) – Felony Child Molestation (5-year-old Minor/36-year-old Adult) Dangerous Crimes Against Children – Not Charged/”Turned Down” by the Pima County Attorney’s Office – Tucson Police Department Investigated (TPD No. 20XX-XXXXXXX3)

Mr. B’s wife was in a Custody Battle with her ex-husband. They shared Custody of the 5-year-old son. At some point, Mr. B’s wife was concerned that the biological father had been Molesting the child. She then got the Tucson Police Department involved and her Family Law Attorney to investigate the biological dad. He in turn, pointed the finger at Mr. B. At that point, the Family Law Attorneys all agreed that polygraph examinations would be administered to all of the parties involved. 

Mr. B’s polygraph was “inconclusive”, and the protocols that were used while he was being examined were not accurate. At this point, he secured the services of DM Cantor to help represent him.

We immediately retrieved the Family Law case file regarding the two parents, to show that they were in a bitter Custody Dispute. In addition, through Discovery, we received a video in which the biological father activated a camera and tried to coach his son that Mr. B had inappropriately touched him. All the son would say was that he was touched by Mr. B on his bellybutton. Ultimately, after contacting the Pima County Attorney’s Office, and the Tucson Police Department, and presenting all of our evidence, they agreed to “Turn Down” the Case. If Mr. B had been Arrested and Charged of these Crimes, he could have spent well over 20 years in Prison. Instead, he has No Criminal History on his Record.
