US v. Mr. B (DMC No. 15733) – Federal Felony Embezzlement/Fraudulent Schemes ($20,404), Federal Felony Wire Fraud, Federal Felony Theft, Federal Felony Money Laundering, and Federal Felony Conspiracy – Not Charged (Due to Cooperation Deal) – FBI and United States Attorney’s Office Investigated (Case No. CR-XX-XXXXX-PHX-XXX)

Mr. B worked in Greenlee County, Arizona for Freeport-McMoRan Mining Company as a journeyman mechanic. He was stationed in the garage to fix various vehicles. It was alleged that he befriended a local automotive parts supplier, and they entered into a Conspiracy to Defraud Freeport-McMoRan. In this Conspiracy, parts were ordered from the automotive parts supplier, and a 33% additional premium was added to the price for Freeport-McMoRan to pay. Mr. B was allegedly given some of that money as a “Kickback”, and also auto parts in exchange for funneling the business to the auto parts shop. The total amount of loss for Freeport-McMoRan was $20,404.

Ultimately, Mr. B received a “Target Letter” from the FBI indicating he was under Investigation. It was at that time that he contacted and secured the services of DM Cantor.  We reached out to the FBI Investigator involved, and to the Assistant United States Attorney in Phoenix, and we began a dialogue. They turned over all of their evidence, and sent over a “Proffer Agreement”, with the request for a “Free Talk”. We ultimately assembled all paperwork, and sat down with the FBI Agent and the Assistant United States Attorney at the United States Attorney’s Office in Phoenix. After all information was provided, and all Cooperation was given, the Prosecutor made the decision to Not Charge Mr. B. Had Mr. B originally been Charged with all violations, he could have spent many Years in Prison. Instead, he has No Conviction on his Record.
