State v. Mr. A (DMC No. 17489) – Felony Sexual Conduct with a Minor (Dangerous Crimes Against Children) 17-year-old alleged Molest of a 9-year-old – Not Charged/”Turned Down” by Pinal County Attorney’s Office – Pinal County Sheriff’s Office Investigated (DR No. 1XXXXXXX0)
Mr. A was a 21-year-old who had a 13-year-old sister who accused him of placing his penis in her mouth when she was 9 years old. When the 13-year-old was at a party with friends, they were all sharing traumatic stories of their life, when she stated that her brother (four years earlier) played the “tasting game” with her. This involved her being blindfolded, and him putting various flavors on his finger and putting it into her mouth. She says that although she was blindfolded, she thinks that one of the times he placed his penis inside of her mouth. After she disclosed this to her friends, they told her mother, and a call was made to the Pinal County Sheriff’s Office and to the Department of Child Safety. When the mother contacted her ex-husband, she informed him that his son (her stepson) had done this to his stepsister. Mr. A was confronted about this and became very upset, and said he would never do something like that. Mr. A’s father then secured the services of DM Cantor to represent him.
The first thing we did was contact the Pinal County Sheriff’s Office, we provided them with an Invocation of Rights. We then secured copies of the Police Report, and interviewed other people who were involved with the case. Ultimately, Mr. A’s stepsister did not actually see what was put in her mouth, but was assuming it was a penis. We were able to show the Pinal County Attorney’s Office that this girl was creating a story in order to “trauma brag” to her friends. No Charges were brought against Mr. A. If he had been convicted, he could have spent years in Prison, and then labeled a Sex Offender for the rest of his life.
