State v. Dr. K (DMC No. 16753) – Endangerment and Assault – Interim Medical License Suspension Only (Until Rehab Complete) – Arizona Medical Board (Case No. MD-XX-XXX9A)
Dr. K and his wife had been to a Kentucky Derby party, and they had had a few drinks. At dinner, they had several more drinks, and then they both got in their car in order to go home. Mr. K’s wife was driving, and she began arguing with Mr. K. Eventually, she struck him in the jaw, and he swung back and struck her in her arm. She then drove into the median, struck a tree, and the airbag was deployed. When Police Officers arrived, they Arrested Ms. K for DUI, and they Arrested Mr. K for Endangerment and Assault. It was at that time he secured the services of DM Cantor.
Although the Endangerment and Assault charges were Dismissed, Dr. K still had to deal with the Arizona Medical Board. We put together an entire package explaining everything that had transpired, and we presented it to the Medical Board. They agreed that there should only be an Interim Suspension in order to allow Dr. K time to complete Alcohol Rehabilitation Classes, and there would be No follow-up beyond that point for a Full Suspension. Dr. K Successfully Completed his Classes, and was allowed to continue practicing medicine. His marriage and his medical practice are both doing fine today.
