State v. Dr. C (DMC No. 16411) – Felony Stalking – Not Charged – Scottsdale Police Department Investigated 

Dr. C had been in an abusive marriage for years, where his wife would frequently assault him. During the course of their ongoing Divorce, he had alleged that she had stolen approximately $500,000 worth of gold coins. He stated she also said in a sworn Deposition she had taken the coins. He eventually was served with an Order of Protection in which his ex-wife claimed “verbal abuse”. 

Using a different attorney, at an Evidentiary Hearing, the Order of Protection was upheld, and a “no firearm provision” was put in place. At that time, Dr. C found an SUV that was registered in his company’s name. However, his ex-wife was also driving that car. He had put two tracking devices on that car (one inside the car, and one under the car). At the Order of Protection Hearing, he admitted to having the tracking devices on the car in order to follow her to find where his stolen gold coins were located.

Immediately after that Evidentiary Hearing, the Scottsdale Police Department impounded the tracking devices. It was at that time his Family Law Attorney suggested he obtain counsel. Dr. C then secured the services of DM Cantor.

Because the vehicle was registered in his company’s name, and during the process of Temporary Orders it was determined that he was the owner of the vehicle, he was allowed to have a tracker on that car. In addition, the Police viewed this as a Family Law matter, and did Not wish to File Charges with the Maricopa County Attorney’s Office. Ultimately, No Criminal Charges were ever brought against Dr. C. If he had been Charged and Convicted, this could have affected his License to Practice Medicine. In addition, he could have been Sentenced to Jail Time. Instead, he has No Criminal Convictions or Criminal Record, and his Medical License is Untarnished.
