REDUCED | EXTREME DUI (.164 BAC) State. vs. Mr. T. (DMC No. 9864) ( Tempe City Court No. 10-070826): Mr. T. was seen driving on University Drive in Tempe. The officer claimed that he was repeatedly weaving back and forth in the center lane. The officer then claimed Mr. T. drove 5 blocks before he pulled over. He eventually provided a .164 breath alcohol reading. We discussed with the prosecutor that the stop was somewhat questionable as it did not appear that Mr. T. ever left his lane markers. Before we filed a motion based on No Reasonable Suspicion to Stop, the prosecutor extended an offer to a first offense DUI with 1 day in jail and dismissed the Extreme DUI which would have required 30 days in jail.
