REDUCED | EXTREME DUI (.164 BAC) State. vs. Ms. P. (DMC No. 9875) (Maricopa City Court No. CR2010-415): Ms. P. had pulled out of a parking lot in her van across a roadway when the officer states that she cut off another vehicle. He subsequently pulled her over and asked her to do field sobriety test. Because the area was too rocky and unsafe, she stated she would rather not take tests and wanted to call her lawyer. Ultimately, blood was drawn which revealed a .164 blood alcohol concentration. Because of the questionable stop and lack of field sobriety test, we were able to convince the prosecutor to offer a regular DUI with 1 day in jail versus the standard minimum of extreme dui with 30 days in jail.
