(DMC No. 9909) (Mesa City Court No. 2010-001867): Mr. D. was seen driving without his headlights on. He turned into a Circle K and was contacted by an officer. Subsequently a DUI investigation ensued and a blood test was conducted which revealed a .198 blood reading. Mr. D. had asked for an attorney, and was not allowed to contact one. An Evidentiary Hearing was set regarding denial of right to counsel, and the state dismissed all charges at that time. Mr. D. was originally facing over 30 days in jail.
