State v. Mr. F (DMC No. 4655)

REDUCED | DISORDERLY CONDUCT with a GUN (dangerous)/DISCHARGE of a FIREARM (Shannon’s Law) REDUCED to a MISDEMEANOR with ZERO DAYS JAIL – State v. Mr. F. (DMC No. 4655) (Maricopa County Superior Court CR2004-016563): Mr. F. had gone shooting with friends earlier in the day, and when he got back to his residence he decided he did not want to have a loaded weapon with him.  He fired 11 shots into a tree and neighbors called police.  We were able to show that nobody was placed in danger, and convinced the Prosecutor to reduce charges to a simple misdemeanor with zero days in jail and 6 months of unsupervised probation.  He was originally facing up to 6 years in prison if convicted on both felonies.

State v. Ms. H (DMC No. 6769)

NOT CHARGED | DISORDERLY CONDUCT with a GUN (dangerous)/DISCHARGE of a FIREARM (Shannon’s Law) NOT CHARGED – State v. Ms. H.  (DMC No. 6769) (Gilbert Police Department DR05-000011264): Ms. H. suffered from alcohol and substance abuse addiction, and had drunk and taken prescription medication before he had gone to sleep.  At some time in the night, he woke up and fired shots through the wall of his bedroom.  His roommate called police and they found Mr. H. in a stuporous state, passed out in the bedroom.  After he was arrested, the police routed the case to the County Attorney’s Office to charge him with disorderly conduct “dangerous” and discharge of a weapon under Shannon’s Law.  He was facing potentially up to 3 years in prison under each charge.  We were able to convince the Prosecutor not to file charges due to the fact that Mr. H. had subsequently successfully completed substance abuse treatment and counseling.

State v. Mr. M (DMC No. 10163)

DISMISSED | DISORDERLY CONDUCT with a KNIFE (dangerous)/CRIMINAL DAMAGE DISMISSED – State v. Mr. M. (DMC No. 10163) (Maricopa County Juvenile Court JV556331): Mr. M. was prescribed medications for depression, and when he was told his mother would not take him to the pet store to buy him a snake, he went into a rage.  He broke tiles on the kitchen counter, and grabbed a knife and threatened those in his household.  We were able to produce medical records showing that Mr. M. had multiple mental health issues, and we put together a management plan regarding his strategies for managing anger.  Because of that, we convinced the Prosecutor to dismiss all charges. If Mr. M. were charged as an adult, he would have faced up to 3 years in prison.

State v. Mr. M. (DMC No. 4807)

ARMED ROBBERY with a GUN (dangerous) REDUCED to PROBATION with 6 MONTHS JAIL- State v. Mr. M. (DMC No. 4807) (Maricopa County Superior Court CR2004-038602): Mr. M. was accused of going with a group of people in order to rob a suspect of drugs while they were in a car.  Police alleged that they came up to the victim, pressed a gun to her chest, and demanded all of their drugs, as well as other property.  Although Mr. M. was facing 7 to 21 years in prison, we were able to show that there were flaws in the photo lineup used to identify Mr. M.  In addition, the only gun found in his possession was a toy gun which shot BB’s.

State v. Mr. G (DMC No. 5213)

NOT CHARGED | ARMED ROBBERY with a GUN (dangerous) NOT CHARGED – State v. Mr. G. (DMC No. 5213) (Mesa Police Department DR2003-1530876): Mr. G. was a 15 year old juvenile who was accused with a group of males of going into a convenience mart and stealing beer at gunpoint.  The owner of the convenience mart, a Vietnamese gentleman, ran outside and began firing his weapon at the vehicle as it was leaving.  Through our investigation, we were able to convince the cops that there was no weapon displayed by any of the young males, and the owner was the only one that possessed a weapon.  Mr. G. was not charged with any crimes and the owner of the convenience store was investigated for excessive use of force and potential aggravated assault dangerous.

State v. Mr. U (DMC No. 5263)

REDUCED | CHILD ABUSE REDUCED to class 6 open/misdemeanor with PROBATION and ZERO DAYS JAIL – State v. Mr. U. (DMC No. 5263) (Maricopa County Superior Court CR2005-005939): Mr. U. had a teenage step son that was very troublesome and had been charged with arson and destroying property in the past.  His step son was getting D’s in school until Mr. U. began a more formalized schedule involving discipline.  When Mr. U. caught his step son destroying more property, he disciplined him with a belt.  He was subsequently charged with a class 4 felony child abuse.  We were able to show the Prosecutor the problematic history of the teenage step son and the Prosecutor agreed to reduce charges to a class 6 open/misdemeanor with probation and no jail.  At the conclusion of probation, Mr. U. only had a misdemeanor on his record.  The step son moved back to Tennessee to be with his biological mother.

State v. Mr. O (DMC No. 4432)

ENDANGERMENT to RECKLESS DRIVING with ZERO DAYS in JAIL – State v. Mr. O. (DMC No. 4432) (Mesa City Court 2003-071445): Mr. O. was involved in divorce with a child custody battle, when he went to his residence to remove some property.  An officer was assigned to do a “civil standby”, and as Mr. O. was leaving,  it was alleged that he swerved at two neighbors that were standing on the sidewalk.  They both jumped back, and then Mr. O. was accused of driving within 12 inches of a patrol car.  We were able to show the Prosecutor that both of the neighbors, and the police officer who conducted the civil standby were friends with Mr. O.’s wife and new boyfriend.  The Prosecutor agreed to reduce the endangerment down to a mere misdemeanor “reckless driving” with zero day’s jail.

State v. Mr. V (DMC No. 5221)

ENDANGERMENT REDUCED to a MISDEMEANOR DUI with TIME SERVED – State v. Mr. V. (DMC No. 5221) (Maricopa County Superior Court CR2002-000730): Mr. V. was charged with being involved in a DUI accident with injuries to a child.  He produced a .183 BAC, and he was arrested for both DUI and felony endangerment.  Through our investigation, we showed that the child was playing with his skateboard and he ran out into the street directly in front of Mr. V.’s car in order to grab the board which had gotten away from him.  We convinced the Prosecutor to dismiss the felony endangerment in exchange for the misdemeanor DUI with a credit for 16 days of jail time which had already been served.  Mr. V. was facing up to 3 years in prison if he were to have been convicted.

State v. Mr. W (DMC No. 5022)

NOT CHARGED | RESISTING ARREST/TRESPASS while on PROBATION – State v. Mr. W. (DMC No. 5022) (Maricopa County Superior Court CR2003-007351): Mr. W. was accused of crashing his car into a neighbor’s house, then running through that house as he escaped.  Mr. W.’s mother stated the Mr. W. had been home the entire time.   In addition, the lady who owned the house stated that the person that ran through the house did not match Mr. W.’s description.  Mr. W. was arrested, the police claimed that after he denied all involvement and he resisted arrest.  We were able to convince the Prosecutor to dismiss all charges, as well as convince the probation office not to file a petition to revoke.  Mr. W. would have been facing over 3 years in prison if charged and convicted.

State v. Mr. T (DMC No. 4919)

DISMISSED | DISORDERLY CONDUCT DISMISSED – State v. Mr. T. (DMC No. 4919) (Maricopa County Juvenile Court JV538918): Mr. T. had gotten into an argument with relatives when a fight broke out.  Police were called, and he was charged with disorderly conduct.  Because he was a juvenile, he was charged in the juvenile court.  We were able to convince the Prosecutor to dismiss all charges in exchange for Mr. T. conducting 16 hours of community service before the next court date.  This occurred, and all charges were dismissed.
