State v. Mr. M (DMC No. 4624)

NOT CHARGED | CHILD MOLESTATION – State v. Mr. M. (DMC No. 4624) (Maricopa County Sherriff’s Office Investigated): Mr. M.’s best friend had a 4 year old daughter, and they would come to Mr. M.’s house for picnic’s and BBQ’s.  Mr. M. was at one of these BBQ’s, when the 4 year olds mother accused him of improperly touching the 4 year old.  He denied these allegations and told the victim’s mom to call the cops and to go have her checked.  He did not have any contact with his best friend, best friend’s wife or the alleged victim for the next 2 years.  The Maricopa County Sherriff’s Office then appeared on his doorstep and began accusing him.  He retained our services, and we had him take a polygraph test and we spoke with Detectives.  No charges were ever brought regarding these false allegations.

State v. Mr. G (DMC No. 10166)

NOT CHARGED | SEXUAL CONUCT with a MINOR (DCAC)/CHILD MOLESTATION (DCAC) – State v. Mr. G. (DMC No. 10166) (Globe Police Department Investigated): Mr. G.’s step daughter was 38 years old when her and her new husband borrowed $45,000 from Mr. G. and his wife.  When they began to miss payments, he threatened to sue her for the balance.  She then made allegations that he had sex with her and molested her when she was a minor, and she reported this to police.  We sat down with Detectives and allowed them to conduct a “free talk” with Mr. G., and he also consented to a polygraph.  Not only did the Globe Police Department decline to route the case for charges, a lawsuit was also filed on Mr. G.’s behalf to recover the $45,000 that he was owed.

State v. Ms. L. (DMC No. 8960)

REDUCED | SEUXAL CONDUCT with a MINOR (8 counts) REDUCED to class 6 open/misdemeanor with PROBATION and 4 MONTHS of JAIL – State v. Ms. L. (DMC No. 8960) (Maricopa County Superior Court CR2008-171392): Ms. L. was a 26 year old female who had a consensual sexual relationship with a 16 year old female.  The relationship had lasted several months, and it was disclosed to a counselor.  She was eventually arrested and charged with 8 counts of Sexual Conduct with a Minor, and was facing 18 years in prison.  We were able to have Ms. L. enrolled in counseling during the pendency of her case, and it was discovered that she herself had been molested at age 5 and 12 by other females.  Through the process of “mitigation”, we were able to secure a class 6 open/misdemeanor offer which included probation and 4 months jail.  After she completes probation, her case will be designated a misdemeanor.

State v. Mr. H (DMC No. 5261)

DISMISSED | SEXUAL CONDUCT with INMATE – State v. Mr. H. (DMC No. 5261) (Maricopa County Superior Court CR2004-018591): Mr. H. was a prison guard at the Perryville woman’s prison.  He was accused with having a sexual relationship with one of the inmates.  He was eventually charged, and we were able to conduct a thorough investigation.  During the investigation, we showed that the alleged victim had since been released, and rearrested and convicted on additional criminal charges.  Due to the all of the issues in the case, the Prosecution dismissed all charges against Mr. H.

State v. Mr. C. (DMC No. 5701)

REDUCED (ALL) | SEXUAL CONDUCT with a MINOR (DCAC) (3 counts), CHILD MOLESTATION (DCAC) (3 counts) and KIDNAPPING (3 counts) ALL REDUCED to CHILD ABUSE with PROBATION and 90 DAYS of DEFERRED JAIL – State v. Mr. C. (DMC No. 5701) (Maricopa County Superior Court CR2005-101311): Mr. C. was a 17 year old high school student who was living with his dad, his dad’s girlfriend and her 13 year old daughter.  On five separate occasions, Mr. C. had sexual contact with the 13 year old daughter which included digital penetration (with his fingers) and oral sexual contact.  It was alleged that he would not allow the 13 year old to leave the room when this occurred, and therefore he was charged with 3 counts of kidnapping, along with 3 counts of Child Molest and 3 counts of Sexual Conduct with a Minor.  We were able to have a Psychosexual Risk Evaluation performed on Mr. C., showing that he was not a risk to reoffend, nor was he abnormal being 17 years of age and attracted to a high school freshman.  We secured an offer to 1 count of Child Abuse with probation and 90 days deferred jail (meaning he did not have to serve them unless he violated probation).  He was originally facing 69 years in prison because the charges were considered “Dangerous Crimes Against Children” (DCAC).

U.S. v. Mr. C (DMC No. 7421)

NOT CHARGED | FEDERAL CHILD PORNOGRAPHY – State v. Mr. C. (DMC No. 7421) (FBI Investigated): Mr. C. was a 17 year old male who was utilized a “file sharing” website when he downloaded some images of child pornography.  Mr. C. was a young man with various learning disabilities, and he was also coming to grips with the fact that he was a homosexual.  The FBI received a “hit” while doing a computer search, and a warrant was issued and a search was conducted on Mr. C.’s house.  All images were found and an Assistant U.S. Attorney was put on to the case.  We were able to deal with the Prosecutor, and she agreed to have Mr. C. perform a Psychosexual Risk Assessment with a treatment plan in exchange for not filing any charges on Mr. C.   Originally Mr. C. was facing over 300 years in prison if he were charged and convicted.

State v. Mr. C (DMC No. 11816)

NOT CHARGED | SEXUAL CONDUCT with a MINOR  –  State v. Mr. C. (DMC No. 11816) (Phoenix Police Department Investigated): Mr. C. was over 18 years old and had been dating his girlfriend who was under 18 while they were both in high school.  They had had sex numerous times over the course of several years when his girlfriend’s mother found her diary.  She found out they had sex when she was 14, 15, and 16, and she contacted police.  Although there were allegations that she was 14 years of age during some of the contacts, which would have exposed Mr. C. to 13 years minimum “day for day” prison for each sex act, we were able to convince the Detective and Prosecutor’s not to bring any charges.

State v. Mr. R (DMC No. 11182)

NOT CHARGED | CHILD PORNOGRAPHY – State v. Mr. R. (DMC No. 11182) (Maricopa County Sheriff’s Office Investigated): Mr. R. was in the middle of a particularly ugly divorce which involved child custody issues, when his wife and her divorce attorney alleged that he maintained child pornography on his computer.  They had taken his computer, hired a computer expert and had them review it for child pornography.  Mr. R. adamantly denied these allegations and we had him take a polygraph test in which he passed.  In addition, we met with Detectives at the Maricopa County Sheriff’s Office and explained to them that the wife had control of this computer for an extended period of time, and it was our belief that she attempted to download child pornography in order to “frame” Mr. R.  The Detectives agreed that the allegations were very suspect, and no charges were brought against Mr. R.  He was originally facing potential life in prison.

State v. Mr. S (DMC No. 4599)

REDUCED | CHILD PROSTITUTION (DCAC) DISMISSED/LURING a MINOR REDUCED to probation with 1 year jail – State v. Mr. S. (DMC No. 4599) (Maricopa County Superior Court CR2004-009084): Mr. S. had gone online into a “chat room”, and made contact with what he thought was a 14 year old girl.  In reality it was an undercover Detective.  He asked the female to prove that she was only 14 by sending a photograph.  The Detective sent a photograph of herself when she was 14.  They arranged to meet at a Carl’s Jr. in order to have sex in exchange for $100.  When he arrived at the Carl’s Jr., he was immediately arrested and, when questioned, he admitted that he had gone there planning to pay to have sex with what he thought was a 14 year old girl.  Because Mr. S. was medically disabled, and had mental issues, we were able to convince the prosecutor to dismiss the charge of child prostitution (which carried a sentence of 13 to 27 years of prison), and to reduce the charge of luring a minor down to probation with 1 year in jail, and the ability to apply for Interstate Compact, so he could move out of Arizona after he completed his jail time.

State v. Mr. M (DMC No. 8586)

REDUCED | LURING a MINOR for SEXUAL EXPLOITATION REDUCED to class 6 open/misdemeanor ATTEMPT with PROBATION and ZERO DAYS in JAIL  – State v. Mr. M. (DMC No. 8586) (Maricopa County Superior Court CR2007-136295): Mr. M. was from out of State and attending a conference at a local Arizona hotel.  He entered into an online chat room while on his computer in his hotel room.  He was discussing sexual fantasies with a person who purported to be 14 years of age, but was conversing at a much higher level.  He then agreed to meet this person for sexual purposes, and drove to a motel they were staying at.  While in the parking lot of the motel, he changed his mind and began exiting the property.  He was pulled over and arrested by a police officer who had been posing as the 14 year old on the computer.  Just prior to trial, the State gave in an offered Mr. M. a class 6/misdemeanor plea to an Attempted Child Abuse with probation and zero day’s jail.  They also allowed him to serve the probation out of State.  The conclusion of Mr. M.’s probation, his case was reduced to a misdemeanor and he has no felony conviction in his record.  Originally, he was facing years in prison.
