State v. Ms. K. (DMC No. 10723)

NOT GUILTY/COMPLETE ACQUITTAL at BENCH TRIAL | CRIMINAL DAMAGE – State v. Ms. K. (DMC No. 10723) (Mesa City Court 2012-004995): Ms. K. was accused of being in an argument with her boyfriend, and hitting him with a pillow and poking him with a finger in the forehead.  She stated she was going to burn his pillows, and the boyfriend said “fine, burn them, I don’t care”.  She did burn the pillows, and she was charged with criminal damage.  At trial, her boyfriend and a witness testified.  We also played the 911 tape, and the Judge found that there was no actual “criminal damage”.  Ms. K. was found not guilty of all charges.

State v. Ms. E (DMC No. 10177)

NOT GUILTY/COMPLETE ACQUITTAL at BENCH TRIAL | MINOR in CONSUMPTION – State v. Ms. E. (DMC No. 10177) (White Tank Justice Court JC2011-102129): Ms. E. was tailgating prior to the Fiesta Bowl game in the stadium parking lot when an officer walked up and asked her submit to a portable breath test which revealed a .023 BAC.  He also forced her to answer the question as to whether she had been drinking, and then he cited her.  At Bench Trial, the Officer could not state why he had probable cause to contact Ms. E. in the first place.  In addition, he had no specific recollection of Ms. E.  The Judge found Ms. E. not guilty of all charges.

State v. Ms. J (DMC No. 10882)

NOT GUILTY/COMPLETE ACQUITTAL at BENCH TRIAL | FALSE REPORTING – State v. Ms. J. (DMC No. 10882) (Yarnell Justice Court CR120766): Mr. J. and his girlfriend were driving to Las Vegas when they were pulled over by police.  His girlfriend was driving and had a suspended license, and she attempted to switch seats with Mr. J.  She was ultimately arrested and when Mr. J. was asked if he was driving, he stated “what if I said I was driving”.  He was then arrested and charged with false reporting to an officer.  At Bench Trial, we convinced the Judge that he committed no crime, and he was acquitted of all charges.

U.S. v. Mr. S. (DMC No. 10821)

NOT CHARGED | FEDERAL FRAUD SCHEMES/BANK and WIRE FRAUD NOT CHARGED – State v. Mr. S. (DMC No. 10821) (Secret Service and U.S. Attorney’s Office Investigated): Mr. S. and co-defendants ran a telemarketing firm regarding a “work at home business”.  Multiple people were charged by State authorities regarding criminal activity, then Secret Service began investigating Mr. S.  We were able to convince the Secret Service and the U.S. Attorney’s Office that Mr. S. was not involved in any fraud.  Although the Secret Service had removed $25,000 from Mr. S.’s safe and filed a forfeiture action regarding that money, no charges were ever brought against Mr. S.

U.S. v. Mr. S. (DMC No. 10740)

NOT CHARGED | FEDERAL FRAUD/MAIL SCHEMES and WIRE FRAUD/COMPUTER TAMPERING NOT CHARGED – State v. Mr. S. (DMC No. 10740) (U.S. Postal Service and U.S. Attorney’s Office Investigated): Mr. S. was accused of hacking into a International shoe manufacturing website and ordering free shoes and apparel under various pro athletes names.  He allegedly had secured over $100,000 worth of items when the postal inspector began investigating.  We were able to work out a “cooperation deal” with the U.S. Attorney’s Office, and no charges were ever brought against Mr. S.

U.S. v. Mr. S (DMC No. 6762)

NOT CHARGED | FEDERAL TRANSPORTATION of  DRUGS FOR SALE/CONSPIRACY NOT CHARGED – State v. Mr. S. (DMC No. 6762) (DEA Investigated): Mr. S. was in a fraternity and he drove with a fraternity brother towards L.A.  He was stopped in Arizona, and a quarter pound of marijuana, cocaine, and 200 pills of ecstasy were found in the vehicle.   His fraternity brother was taken into jail, and Mr. S. was released.  We were able to enter into cooperation deal with the DEA Investigator and no charges were ever brought against Mr. S.

U.S. v. Mr. C. (DMC No. 4579)

NOT CHARGED | FEDERAL BANK and WIRE FRAUD NOT CHARGED – State v. Mr. C. (DMC No. 4579) (FBI Investigated): Mr. C. was accused by Meridian Bank of “kiting” funds.  The bank accused him of having several accounts, and wiring funds into one account while writing checks on the first account before the money actually posted on the second account.  Through this “check kiting activity”, they claimed a half a million dollars had been lost.  We’re able to show the Investigators this was a civil matter, and that no criminal activity had been conducted.  No criminal charges were brought against Mr. C.

U.S. v. Ms. M (DMC No. 5005)

REDUCED | FEDERAL THEFT REDUCED to PROBATION with ZERO DAYS JAIL – State v. Ms. M. (DMC No. 5005) (U.S. District Court for Arizona 04CR-00227-002-PHX-NVW): Ms M.’s boyfriend had burglarized a suburban vehicle owned by the U.S. Department of Interior, Bureau of Reclamation.  Approximately $80,000 worth of items was stolen including three specialized GPS devices.  Ms. M. placed these devices for sale on EBay, and the Department Homeland Security and FBI arrested her.  She was originally facing Theft of Government property charges which carried 5 years of prison.  We were able to reduce it to probation with zero days in jail.

U.S. v. Mr. B (DMC No. 10625)

NOT CHARGED | FEDERAL MORTGAGE FRAUD – State v. Mr. B. (DMC No. 10625) (Small Business Administration Investigated): Mr. B. had obtained a loan to build four buildings for his company.  When he secured the loan, he checked the “no” box when it had asked about prior felony convictions.  In reality, he had a prior felony.  Ultimately, the bank foreclosed on all four buildings, and over 1 million dollars was lost.  The banks attorney’s indicated they would be charging Mr. B. if he did not pay back the money.  We were able to work with The Small Business Administration Investigator and no charges were ever brought.

U.S. v. Mr. H (DMC No. 10193)

NOT CHARGED | FEDERAL TRAFFICKING of STOLEN GOODS NOT CHARGED – State v. Mr. H. (DMC No. 10193) (Department of Defense Investigated): Mr. H. had purchased numerous night vision equipment from a seller on Craig’s List.  He then resold the items on EBay.  It was discovered that about half of these night vision goggles were protected Military equipment pursuant to Department of Defense rules.  We were able to work with the Department of Defense Investigator, and show them exactly who sold the items to Mr. H.  These original items were stolen from a security locker off site away from a Military base located out of State.  That person was eventually prosecuted, and Mr. H. was never charged with any crimes.
