State v. Ms. B. (DMC No. 4551)

HIT AND RUN REDUCED to “unsafe backing” ticket – State v. Ms. B. (DMC No. 4551) (Surprise City Court TR04-02050): Ms. B. had been backing out of her driveway when she struck a car that parked across the street in order to visit a friend.  She then drove away, and a neighbor reported her to police.  When contacted by police she denied being involved in the accident, although she admitted to driving and that her stereo had been very loud.  The prosecution was eventually convinced to offer her a plea to “unsafe backing” for a fine of $113.

State v. Mr. N. (DMC No. 10404)

HIT AND RUN REDUCED to “speeding” ticket at Bench Trial – State v. Mr. N. (DMC No. 10404) (Scottsdale City Court TR-2011015309): Mr. N. was coming up to 70th Street and McDowell Road when he observed a vehicle stopped at a red light backing up rapidly.  He misjudged the distance and struck the car in front of him.  That vehicle then made an illegal u-turn, and Mr. N., believing damage was minimal drove on home.  Upon being contacted by police he initially did not admit to being involved in the accident.  Because the accident was the other drivers fault (in our opinion) the case was set to bench trial.  On the day of bench trial, the State agreed to dismiss the hit and run in exchange for a plea to a simple speeding ticket.

State v. Ms. L (DMC No. 4805)

HIT AND RUN REDUCED to “speeding” ticket – State v. Ms. L. (DMC No. 4805) (Chandler City Court 04-C-2392): Ms. L. had pulled her vehicle into a parking lot and had accidentally struck another vehicle.  She then moved her vehicle and parked it in a different location without contacting the other vehicles owner.  Witnesses got her license plate and she was tracked down at her home.  We were able to convince the prosecutor to reduce the charge from hit and run down to a civil speeding ticket with only a fine.

State v. Mr. M (DMC No. 4388)

HIT AND RUN DISMISSED – State v. Mr. M. (DMC No. 4388) (White Tank Justice Court TR03-12137CR):  Police received a call about a vehicle striking an off ramp sign on the south bound 101.  Police ultimately contacted Mr. M. who admitted to driving.  Because the damage had been paid for by Mr. M.’s insurance, combined with the fact that nobody saw him driving, we were able to file a Motion based on “Corpus Delicti”, and all charges were dismissed.

State v. Mr. T (DMC No. 4652)

HIT AND RUN DISMISSED – State v. Mr. T. (DMC No. 4652) (Chandler City Court 04-C-2307171): Mr. T. was accused of striking parked vehicles and then driving to his home without exchanging insurance information.  When officers arrived, they startled him out of bed and he stood up and struck a police officer.  He was charged with hit and run and assault on an officer.  We were able to have the hit and run dismissed, and the assault on the officer charged only as a misdemeanor (as opposed to a felony) with probation and $250 fine.

State v. Mr. A (DMC No. 10897)

HIT AND RUN NOT CHARGED – State v. Mr. A. (DMC No. 10897) (Scottsdale Police Department 11-27338): Mr. A. had rear-ended a car at nighttime, and then he stuck his head out of his window and asked if everyone was ok.  After the driver said he was ok, Mr. A. drove off.  Ultimately, Detective left a card at Mr. A.’s home address.  We were able to assist with exchange of insurance information, and the alleged victim no longer desired prosecution.  The Detective agreed to not route the file for charges.

State v. Ms. W (DMC No. 6476)

HIT AND RUN NOT CHARGED – State v. Ms. W. (DMC No. 6476) (Phoenix Police Department DR2005-51490140): Ms. W. was involved in an accident in which she hit a motorized scooter.  She originally panicked and left the scene and then came back 5 minutes later.  When she was ultimately contacted by police, she admitted her mistake and stated that she had panicked.  We were able to assist in the exchange of insurance information, and we monitored the case until the statute of limitations had run.  No charges were ever brought.

State v. Mr. F (DMC No. 4689)

HIT AND RUN NOT CHARGED – State v. Mr. F. (DMC No. 4689) (Gilbert Police Department investigated): Mr. F. had hit a curb, a tree, and a sidewalk when his tire went flat.  He left on foot and was ultimately contacted by an officer from Gilbert PD.  We intervened and called the officers back and invoked Mr. F.’s 5th Amendment rights.   Because there was no way to put Mr. F. behind the wheel, charges were never brought.

State v. Mr. P (DMC No. 4508)

HIT AND RUN NOT CHARGED – State v. Mr. P. (DMC No. 4508) (Tempe Police DR03-056912): Mr. P. was accused of backing into a vehicle and then leaving the scene.  Although a license plate number was taken, that vehicle was registered to somebody other than Mr. P.  Mr. P. was ultimately tracked down and arrested for an alleged hit and run.  We were able to exchange insurance information and convince the Tempe Prosecutors Office not proceed with charges.

State v. Mr. C (DMC No. 10832)

HIT AND RUN NOT CHARGED – State v. Mr. C. (DMC No. 10832) (DPS DR2011-039814): Mr. C. was involved in an alleged multi-car accident in which he did not remain at the scene.  Later, DPS Officers contacted his step brother.  We were able to provide insurance information and all damage was paid pursuant to the “permissive use statute” and we were able to protect Mr. C. by invoking his 5th Amendment rights.  Untimely, the 1 year statute of limitations ran and no charges were ever brought.
