State v. Mr. Z (DMC No. 10718)

NOT CHARGED | VEHICULAR AGGRAVATED ASSAULT – State v. Mr. Z. (DMC No. 10718) (Scottsdale PD investigated): Mr. Z. was at a Christmas party, when another individual noticed Mr. Z.’s BMW M3. That other individual asked to go for a ride in the vehicle, and they both left. Each of them took turns driving the car, and both had been drinking. Subsequently, the vehicle was involved in a wreck in which both parties were knocked unconscious and went to the hospital and had no memory of who was driving. Eventually, the other party claimed Mr. Z. was driving and filed a law suit in order to collect insurance money. We were able to convince the police that they could not accurately place Mr. Z. behind the wheel, and no charges were brought. He was originally facing 5 to 15 years in prison.

State v. Mr. V (DMC No. 10336)

DISMISSED/NOT CHARGED | AGGRAVATED ASSAULT WITH GUN DISMISSED/HIT AND RUN NOT CHARGED – State v. Mr. V. (DMC No. 10336) (Maricopa County Superior Court CA2009-055168): Mr. V. was driving in Cave Creek when he and another vehicle side swiped each other. They both pulled into a Bashas’ parking lot when the other driver ran up to Mr. V.’s window in an excited and angry manner. Mr. V. had a gun in a holster, which he kept for his protection, and he displayed this weapon to the other driver. The other driver ran away, got in his car, left and called police. We were able to convince the police that there was no hit and run as the other driver had left, and we also explained to the prosecutor that Mr. V. was justified in displaying his weapon. Even though he had been charged with AGGRAVATED ASSAULT with a gun and was facing 5 to 15 years in prison, all charges were dismissed.

State v. Ms. L. (DMC No. 11667)

Not Guilty / Complete Acquittal / Felony Aggravated Assault (2 Counts) – State v. Ms. L. (DMC No. 11667) (Maricopa County Superior Court No. CR2013-102278-001):

Ms. L. had called 911 due to a domestic violence dispute in her home in Mesa, Arizona where her roommate had assaulted her. Two Mesa Police Officers arrived and eventually claimed that Ms. L. assaulted them. One officer claimed that Ms. L. pushed him, and the other claimed that Ms. L. spit on him. Knowingly touching a police officer with the intent to insult, injure, or provoke him/her is a Felony Aggravated Assault. The entire incident was captured on video from a mounted camera on one of the officer’s shoulders. After jury trial in which the attorney from our firm showed through testimony of various witnesses that the police officers lied both in their police reports and on the witness stand Ms. L. was found not guilty on both charges by the jury of her peers.

State v. Ms. K (DMC No. 11498)

Not Guilty / Complete Acquittal at Bench Trial – Vehicular Homicide / Misdemeanor Manslaughter – State v. Ms. K (Oct. 20, 2013) (DMC No. 11498) (Phoenix City Court – 4636123): Ms. K was traveling with a friend in her vehicle when she was headed south bound on 59^thAvenue. She began making a left hand turn when a motorcycle zoomed up on the left hand lane headed north bound, and had struck the back quarter panel of her vehicle. The motorcyclist died on the scene. Ms. K was then investigated and charged with Vehicular Homicide/Misdemeanor Manslaughter per Arizona Revised Statute ARS 28-672 (A4). We became involved in the case, and we interviewed the numerous Officers and civilian witnesses who were involved.

The key witness was a driver of a construction truck who was headed north bound in the middle lane. He had dark tinted windows and a large vehicle. He stated that the victim was on his motorcycle following him at approximately 45 miles per hour. He stated that just prior to the intersection where the collision occurred, the motorcycle snapped into the left lane, and “opened it up” to 70 miles per hour. This was occurring right as Ms. K was making her left hand turn.

At Bench Trial, we introduced evidence that Ms. K’s view was blocked by the truck. This was confirmed by the truck driver. In addition, we were able to show that the victim in the case was driving recklessly on his motorcycle, and he was a major causation of the accident. The Judge agreed and Acquitted Ms. K on all criminal charges.

State vs. Ms. K (DMC No. 9737)

State vs. Ms. K. (DMC No. 9737) (Scottsdale City Court No. CR2010-024501): Ms. K. was in an argument with her husband when she threw a washcloth used to bathe the baby at him. Her husband became angry and then shoved her out the door and threw her down to the ground. She struck a table and was knocked unconscious. The maid then came in and saw her injuries and called the police. Ms. K. was taken to the hospital and she told the police her story. When the police interviewed Mr. K., he stated he only pushed his wife after she slapped him with a wet towel across the face. The officer chose to believe Mr. K.’s story, and charged Ms. K. We were able to show through crime scene photos that there were numerous marks on Ms. K’s body and that her story was accurate. The prosecutor agreed and dismissed all charges.

State v. Mr. P (DMC No. 1816)

REDUCED | ARMED ROBBERY/KIDNAPPING – (DMC No. 1816) (Maricopa County Superior Court No. CR2000-090604): Mr. P. and a co-defendant were owed money from some individuals. They were alleged to have gone into the house with ski masks and guns in order to get their money back. There was a pizza delivery man inside of the house along with others, who ran out of the house and police were called. Although Mr. P. was facing a mandatory minimum of over 10 years in prison, we were able to reduce all charges to a low level burglary which include probation and 60 days in jail.

State v. Mr. H (DMC No. 9801)

DISMISSED – Disorderly Conduct- State v. Mr. H. (DMC No. 9801) (Tempe City Court No. 2010-035486): Mr. H. was at the Big Bang Bar in Tempe when he got into an argument with some bouncers. Police walked up and claimed that Mr. H walked at them aggressively. They then took him to the ground and he was arrested for disorderly conduct. We were able to show that this was all a misunderstanding fueled by alcohol, and that the case should be dismissed upon completion of some alcohol classes. Because Mr. H was a U.S. Airways employee, this result saved his job.

State v. Ms. H (DMC No. 9104)

CONVICTION SET ASIDE | RESISTING ARREST/TRESPASSING/DISORDERLY CONDUCT CONVICTION EXPUNGED – State v. Ms. H. (DMC No. 9104) (Maricopa County Superior Court No. 2009-161454): Ms. H had been drinking and was at the Westgate Shops over by the Jobing.com Arena. An officer approached her outside of a bar, and she got into a verbal altercation. The officer became angry, and pushed Ms. H to the side of the car. She reacted and then was arrested and charged with Disorderly Conduct, Trespassing, and Resisting Arrest. We were ultimately able to have charges reduced to a Class 1 Misdemeanor for Resisting Arrest. After that, we were able to have the conviction Set Aside and Expunged.

State v. Ms. P (DMC No. 7150)

REDUCED | Vehicular Aggravated Assault, State v. Ms. P. (DMC No. 7150) (Maricopa County Superior Court No. CR2007-006244): Ms. P. was involved in a traffic accident which resulted in 3 Counts of Aggravated Assault Dangerous, and 2 Counts of Endangerment Dangerous. One victim had a broken back, and another victim was ejected from her car, suffering vertebrae injuries. The victim’s vehicle appeared to have been speeding and may have cut off Mr. P. Because Ms. P. had been drinking alcohol, the police drew blood which resulted in a .095 BAC. She was subsequently charged with numerous charges which could have resulted in over 50 years in prison. Even though the initial offers started at 5 years in prison and came down to 2.5 years, we were able to conduct a Settlement Conference and ultimately secured an offer of probation with 6 months of jail with work furlough.

State v. Mr. W (DMC No. 7248)

REDUCED to Misdemeanor DUI – Vehicular Aggravated Assault, State v. Mr. W. (DMC No. 7248) (Maricopa County Superior Court No. CR2007-131438): Mr. W. was involved in a traffic accident in which several people were injured. One of the people required staples to be put into his head. Mr. W. had a .19 blood alcohol reading, along with cocaine, marijuana and narcotics in this system. Because of the injuries to the victim, he was facing a potential 5 to 15 years in prison. He was also facing a potential felony DUI because his license was suspended. We were able to exploit various weaknesses of the case and get it plead to a misdemeanor DUI with 1 day in jail.
