State v. Ms. R. (DMC No. 4656)

REDUCED | 2 COUNTS of FORGERY/THEFT REDUCED to class 6 open/misdemeanor with PROBATION and ZERO DAYS in JAIL – State v. Ms. R. (DMC No. 4656) (Maricopa County Superior Court CR2004-014768): Ms. R. was accused of taking her credit card out of another woman’s purse at a local gym and purchasing over $500 of various items.  Although she was charged with 3 felonies, we were able to have the case reduced to a simple “possession of forgery device” which was a class 6 open/misdemeanor with probation and zero day’s jail.  Upon probation, the case was designated a misdemeanor and Ms. R. has no felony on her record.

State v. Mr. M (DMC No. 4887)

DISMISSED | SHOPLIFTING – State v. Mr. M. (DMC No. 4887) (Phoenix City Court 3164538): Mr. M. was at a Home Depot, when he was accused of attempting to leave the store with a metal door valued at a $175.  He was charged with shoplifting, and we were able to show the Prosecutor that he was diagnosed with Alzheimer’s approximately 3 years earlier.  After going through the Prosecutor’s “Hardship Committee”, we were able to convince them to dismiss the shoplifting exchange for some classes under a “diversion” program.

State v. Mr. A (DMC No. 4980)

REDUCED | TRANSPORTATION of MARIJUANA for SALE (215 pounds)/MONEY LAUNDERING ($31,000) and RESISTING ARREST REDUCED to POSSESSION of MARIJUANA and FELONY FLIGHT with PROBATION and ZERO DAYS in JAIL – State v. Mr. A. (DMC No. 4980) (La Paz County Superior Court CR2004-0502;CR2003-0283): Mr. A. was travelling as a passenger in a car that was pulled over for travelling 78 mph in a 75 mph zone.  The officer then asked if the two were “engaged in criminal activity”.  A drug dog was brought out who sniffed the car and altered to the presence of marijuana.  Mr. A. then exited the car and ran away.  He was then taken into custody, and he said he ran because he saw the officer was “jacking up his friend”.  215 pounds of marijuana and $31, 000 in cash were found inside the vehicle and Mr. A. was charged with “transportation of marijuana for sale”, “money laundering” and “resisting arrest”.  Due to the questionable nature of the stop, we were able to reduce his charge down to a mere felony flight with possession of marijuana which included probation and zero day’s jail.  He was originally facing over a decade in prison.

State v. Mr. C (DMC No. 10534)

REDUCED (ALL) | ILLEGAL CONDUCT of an ENTERPRISE/CONSPIRACY/PROMOTION of GAMBLING and LIQUOR LICENSE VIOLATION ALL REDUCED to class 6 open/misdemeanor and PROBATION with ZERO DAYS JAIL – State v. Mr. C. (DMC No. 10534) (Maricopa County Superior Court CR2012-006937): Mr. C. had opened up a business regarding indoor golf simulation and began having a poker game occur in the back of his business.  He then leased the space to another gentleman who ran a poker game (for profit) in the back room.  Mr. C. was charged with “conspiracy” and “illegal conduct of an enterprise”, along with gambling and liquor violations.  We were able to have everything reduced to a class 6 open/misdemeanor, in which the judgment of guilt was set aside immediately at sentencing.  Mr. C. has no conviction on his record.

U.S. v. Mr. S (DMC No. 6444)

NOT CHARGED | BANK and WIRE FRAUD/FRAUD SCHEMES NOT CHARGED – State v. Mr. S. (DMC No. 6444) (FBI Investigated): Mr. S. was accused of having his friend (who worked for a local bank) manufacture a MasterCard with his name on it with a fraudulent credit card number.  He was then accused of utilizing that card to make multiple purchases.   When the FBI investigated, we became involved and invoked Mr. S. right to remain silent.  Because the Agent lacked any evidence that Mr. S. had personally utilized this card, or had been in any way involved, no charges were ever brought against him.

State v. Mr. P (DMC No. 10862)

NOT CHARGED | SHOPLIFTING – State v. Mr. P. (DMC No. 10862) (Glendale Police Department DR12-034118;DR11-094847;DR11-104230): Mr. P. was accused of shoplifting video games at a Walmart.  The Walmart’s Loss Prevention Officer’s then claimed that he had done it three other times.  He was arrested and charged with the shoplift of the video games.  During our investigation, we were able to convince the Prosecutor that no evidence existed for the other three shoplifting allegations.  If all four shoplifting had been filed against Mr. P. he would have been looking at two separate felonies and two separate misdemeanors, which could have exposed him to prison time.

State v. Mr. B. (DMC No. 9560)

PERJURY and FALSE SWEARING NOT CHARGED – State v. Mr. B (DMC No. 9560) (Mesa Police Department Investigated): Mr. B was a retired Mesa Police Detective who conducted fraud investigations regarding “securities” for the state of Arizona. During one of his cases, he testified to a Grand Jury regarding certain elements of his investigation into a Church Securities Fraud. It appears that he had inadvertently testified that a finance committee did not exist for the church, when it was later determined that it did. We were able to sit down with current Detectives in the Mesa Police Department and do a “free talk” with them and Mr. B. Based on this free talk, the Maricopa County Attorney’s Office declined to file charges for Perjury under Arizona Revised Statute ARS 13-2702, nor did they file charges for False Swearing under Arizona Revised Statute ARS 13-2703.

U.S. v. Mr. S. (DMC No. 10821)

NOT CHARGED | FEDERAL FRAUD SCHEMES/BANK and WIRE FRAUD NOT CHARGED – State v. Mr. S. (DMC No. 10821) (Secret Service and U.S. Attorney’s Office Investigated): Mr. S. and co-defendants ran a telemarketing firm regarding a “work at home business”.  Multiple people were charged by State authorities regarding criminal activity, then Secret Service began investigating Mr. S.  We were able to convince the Secret Service and the U.S. Attorney’s Office that Mr. S. was not involved in any fraud.  Although the Secret Service had removed $25,000 from Mr. S.’s safe and filed a forfeiture action regarding that money, no charges were ever brought against Mr. S.

U.S. v. Mr. C. (DMC No. 4579)

NOT CHARGED | FEDERAL BANK and WIRE FRAUD NOT CHARGED – State v. Mr. C. (DMC No. 4579) (FBI Investigated): Mr. C. was accused by Meridian Bank of “kiting” funds.  The bank accused him of having several accounts, and wiring funds into one account while writing checks on the first account before the money actually posted on the second account.  Through this “check kiting activity”, they claimed a half a million dollars had been lost.  We’re able to show the Investigators this was a civil matter, and that no criminal activity had been conducted.  No criminal charges were brought against Mr. C.

U.S. v. Ms. M (DMC No. 5005)

REDUCED | FEDERAL THEFT REDUCED to PROBATION with ZERO DAYS JAIL – State v. Ms. M. (DMC No. 5005) (U.S. District Court for Arizona 04CR-00227-002-PHX-NVW): Ms M.’s boyfriend had burglarized a suburban vehicle owned by the U.S. Department of Interior, Bureau of Reclamation.  Approximately $80,000 worth of items was stolen including three specialized GPS devices.  Ms. M. placed these devices for sale on EBay, and the Department Homeland Security and FBI arrested her.  She was originally facing Theft of Government property charges which carried 5 years of prison.  We were able to reduce it to probation with zero days in jail.
