State v. Mr. B (DMC No. 10031)

DISMISSED AT BENCH TRIAL | ASSAULT/CRIMINAL DAMAGE/DISORDERLY CONDUCT State vs. Mr. B. (DMC No. 10031) (Apache Junction Justice Court No. 2010-0207): Mr. B. was in the process of filing for divorce against his wife who was constantly accusing him of cheating on her.  She attacked him several times during the course of one night and scratched his face.  He then physically pushed her in order to defend himself.  During the course of this altercation, his cell phone was damaged.  Mr. B.’s ex-wife waited until the next day to report the incident to the police while at a friend’s house.  On the day scheduled for Bench Trial, we explained all factors to the prosecutor involving self defense, and they moved to Dismiss the case at that time.

State vs. Mr. M (DMC No. 10019)

NOT CHARGED | TRESPASSING – State vs. Mr. M. (DMC No. 10019): Mr. M. was at the Talking Stick Casino with a friend, and both had been drinking heavily.  Mr. M. was shoved out of an elevator, just prior to his friend going down to the casino.  When he caught up with his friend, they engaged in a verbal argument.  Casino staff were called and asked Mr. M. to leave, and he refused.  He was eventually arrested by Salt River PD and charged with trespass.  We were able to convince the prosecutor that he was merely upset and exercising his right to free speech and that this case should not be charged.  They agreed and no charges were re-filed.

State vs. Mr. S (DMC No. 9990)

REDUCED TO MISDEMEANOR | FELONY TRESPASSING – State vs. Mr. S. (DMC No. 9990) (Maricopa County Superior Court No. CR2011-108115): Mr. S. was suffering from a psychotic episode while attending ASU.  A fire drill occurred at his apartment complex, when he entered another person’s room and began taking a shower without their permission.  When police arrived, he was taken into custody and taken to the Tempe City jail.  He began acting in a very erotic matter and eventually taken to a mental health facility where he spent 5 days.  Due to his mental health state, we were able to convince the prosecutor to reduce the felony down to an outright Misdemeanor with Probation and no jail.  In addition, they would not charge him with any crimes related him stripping naked in front of the apartment resident prior to getting into the shower.

State vs. Mr. S (DMC No. 9983)

REDUCED | BURGLARY AND AGGRAVATED CRIMINAL DAMAGE – State vs. Mr. S. (DMC No. 9983) (Maricopa County Superior Court No. 2007-133818-002): Mr. S. was an 18 year old high school student who went with several of his friends to a local junior high.  They took several golf carts and drove them around the school and crashed them into walls.  They also utilized fire extinguishers to engage in other acts of Criminal Damage.  Although Mr. S. was originally charged with class 4 Burglary and class 5 Aggravated Criminal Damage, we were able to convince the prosecutor to mitigate the punishment down to a class 6 undesignated felony for Possession of Burglary Tools.  He was given 12 months probation, and after he paid restitution and completed probation, his charge became a misdemeanor.  He has no felony record and did not spend any time in jail.

State vs. Mr. M (DMC No. 9938)

DISMISSED | TRESPASSING – (DMC No. 9938) (Tempe City Court No. 10-069698-2): Mr. M. was a Canadian citizen visiting in Tempe. He was accused becoming intoxicated at the Margarita Rocks Bar in Tempe, Arizona and he was asked to leave. Staff claimed that he then hopped a fence and refused to leave once he was back on the bars’ patio. Police were called and he was arrested for trespass. If he were to be convicted, he would not be allowed to re-enter the United States per then current immigration law. After numerous meetings with the prosecutors in Tempe, they agreed to allow Mr. M. to do community service. Once that service was complete, they dismissed all charges.

State v. Mr. H. (DMC No.)

REDUCED | DUI (Tempe City Court No.: 03-651009-2CR): Mr. H. was stopped for allegedly traveling 55 in a 40, and tail gating the vehicle in the front of him. He was under 21 years of age, performed poorly on field sobriety tests and a marijuana pipe was found in his glove box. He subsequently provided a breath sample which was above the legal limit; however he is still under 21 years of age. Due to the facts of the case, we were able to negotiate a plea to a reckless driving with zero days in jail.
