State v. Mr. C. (DMC No. 11132)

OUI (.074 BAC) REDUCED to NEGLIGENT OPERATION of WATERCRAFT with ZERO DAYS in JAIL – State v. Mr. C. (DMC No. 11132) (North Mesa Justice Court JC2012-137199): Mr. C. was on the lake with his boat and was towing an inner tube with his three children riding on it.  He was going approximately 5 to 10 mph, and he moved left to allow another boat (that was over 100 feet away) to pass to the right.  Deputies pulled him over in his boat and claimed that he “failed to yield”.  An OUI investigation subsequently ensued and he produced a .074 BAC.  We were able to negotiate with the Prosecutor and get them to dismiss the OUI in exchange for a simple “negligent operation of a watercraft” with a small fine and no jail time.

State v. Mr. W (DMC No. 4774)

DISMISSED | SUPER EXTREME DUI (.200 BAC) DISMISSED – State v. Mr. W. (DMC No. 4774) (North Mesa Justice Court TR03-03368CR): Police arrived at State Route 87 and mile post 206 when they were called to the scene of a single car accident.  Mr. W.’s vehicle had struck a post and had gone off in an embankment.  Mr. W. was not behind of the wheel of the car when officers arrived.  He was subsequently arrested and provided a .200 blood alcohol concentration and was charged with SUPER EXTREME DUI.  We were able to preclude the primary officer into the case from testifying due to his violation of the discovery rules.  The case was dismissed.

State v. Ms. G (DMC No. 6160)

PARTIAL AQUITTAL at BENCH TRIAL | DISORDERLY CONDUCT – State v. Ms. G. (DMC No. 6160) (North Mesa Justice Court JC2006117168): Ms. G. was on a bus with some friend’s when an argument broke out with another group of teenager’s. She had been drinking prior to this. She was charged with underage drinking, assault and disorderly conduct. At Bench Trial, the Judge found her not guilty of the disorderly conduct, due to the fact that she was not the one responsible for starting the initial fighting.

State v. Ms. B (Case No. 03-04339CR)(DMC No.)

(North Mesa Justice Court- No.:03-04339CR): Ms. B. was stopped for allegedly making a wide right turn. She performed poorly on field sobriety test and was arrested, and subsequently submitted to a blood test which resulted in a .140 BAC. We filed a Motion to Dismiss based upon no reasonable suspicion to stop, and the state offered a plea to a reckless driving charge with a zero days in jail.
