State v. Mr. A. (DMC No. 5793)

AGGRAVATED DUI (methamphetamine) – class 4 FELONY REDUCED to Misdemeanor DUI with 1 DAY in JAIL – State v. Mr. A. (DMC No. 5793) (Maricopa County Superior Court CR2005-031868): Mr. A. was observed travelling 75 to 80 mph on State Route 87, when he weaved 3 times over the line during a 2 mile stretch. He subsequently was pulled over and found to have a suspended license. In addition, he was accused of smoking methamphetamine (due to a glass pipe being found in his possession). Due to the questionable nature of the stop, we were able to have the case reduced from a class 4 felony, which included a minimum of 4 months in prison, down to a mere 1st offense regular DUI with only 1 day in jail.

State v. Mr. K (DMC No. 4334)

REDUCED | DUI DRUGS (Marijuana) REDUCED to DUI alcohol – State v. Mr. K. (DMC No. 4334) (Gilbert City Court 02TR15328DU): The officer indicated he saw a “green coating on Mr. K.’s tongue”, and arrested him for DUI.  Although he only had a breath test reading of 025, urine was subsequently collected.  Even though marijuana metabolites showed up in his urine, there was a potential “no reasonable suspicion to stop” issue along with a possible Miranda rights violation.  We were able to secure a DUI alcohol plea in exchange for dismissing the DUI drugs, thereby saving Mr. K. the 1 year license suspension.

State v. Mr. L (DMC No. 4965)

NOT CHARGED/REDUCED | POSSESSION OF DANGEROUS DRUGS NOT CHARGED DUI/DRUGS (Meth) REDUCED to DUI alcohol – State v. Mr. L. (DMC No. 4965) (Phoenix City Court 3154717): Mr. L. was stopped at Indian School Road & 19th Avenue for having an improper tag on his license plate.  He subsequently was removed from the car and refused to do field sobriety tests or give a blood or breath test.  While he was at the police station his wallet was searched and methamphetamine was found inside.  He ultimately tried to leave a message for a lawyer, but nobody called him back.  When blood was ultimately drawn, it revealed a .094 blood alcohol content and the presence of methamphetamine.  Due to potential denial of right to counsel and stop issues, we were able to have the DUI drugs charged dismissed in exchange for a DUI alcohol, charge thereby sparing Mr. L. the 1 year license suspension.

State v. Mr. M (Case No. 2011-P-879920) (DMC No.)

REDUCED | SECOND OFFENSE DUI REDUCED to FIRST OFFENSE REGULAR DUI- State v. Mr. M. – (Chandler Court- No. 2011-P-879920): Mr. C. was originally offered a second offense regular DUI. Mr. C. performed fair on field sobriety test and was arrested, and subsequently submitted to a blood test which yielded a positive metabolite of THC. After filing a Motion to Dismiss for no Reasonable Suspicion for the Stop and No Probable Cause for the Arrest, the State agreed to offer a plea to a first offense regular DUI, with one day of jail.

State v. Mr. O (DMC No. 5507)

DUI DRUGS (marijuana) REDUCED to DUI alcohol with 1 DAY in JAIL – State v. Mr. O. (DMC No. 5507) (Snowflake Justice Court CR2005-0157MI): DPS Officers claimed they were at State Route 260 near Mile Post 306 near Snowflake, Arizona when they observed Mr. O. travelling 59 in a 45 mph zone.  After he was stopped, they claimed they could smell a strong odor of marijuana and they processed Mr. O. for a DUI drugs charge.  After conducting a Drug Recognition Evaluation (DRE), he was arrested and a marijuana pipe with marijuana was found in his vehicle.  Mr. O. subsequently provided a urine test which showed the presence of the active metabolite of marijuana (THC).  Because of the questionable search of his vehicle, we were able to convince the Prosecutor to not file charges for Possession of Drug Paraphernalia and Marijuana.  We also convinced him to reduce the DUI “drugs” charge to a DUI “alcohol” charge, which saved Mr. O.’s license from being suspended for a full year.
