State v. Mr. H. (DMC No. 7245)

REDUCED | DUI – State v. Mr. H. (DMC No. 7245) (Tempe City Court No. 07-983218): REDUCED to Reckless Driving Mr. H was found stopped at a green light asleep with his engine on and his foot on the brake pedal. He ultimately provided Field Sobriety Tests and a Preliminary Breath Test of .085. After he was arrested, he was taken to the station and requested to call our office. After he was done on the phone, he did not provide any answers to questions and did not perform any further tests. Due to the lack of evidence, we were able to convince the Prosecutor to extend the Reckless Driving offer with 0 days in jail.

State V. Mr. L. (DMC No. 9838)

REDUCED | DUI (.084 BAC) (DMC No. 9838) (Chandler City Court No. 10-C-3606061-2): Mr. L. was travelling with four passengers when he failed to move forward through a light which had turned green. He was talking with his passengers when the light had changed, and the officer immediately activated his lights. Mr. L. had a moderate odor of alcohol, and the officer stated that he failed the field sobriety test. His blood results eventually came back a .084 and we were able to convince the prosecutor they would most likely not win a trial. The prosecutor then agreed to dismiss the DUI charge in exchange for a plea to a Reckless Driving which involved no jail time.

State v. Ms. M. (DMC No. 5048)

REDUCED to RECKLESS DRIVING with ZERO DAYS in JAIL | DUI (.082 BAC) – State v. Ms. M. (DMC No. 5048) (Avondale City Court TR2004-01954):  Ms. M. was seen driving at 119th Avenue and Indian School Road in Avondale, Arizona when it was alleged she was weaving outside her lane.  She was pulled over, and her and her passenger both had an odor of alcohol.  After being administered field sobriety tests, she was arrested and taken to the station where she was given a breath test.  Her breath reading was a .082.  We were able to show the Prosecutor that her passenger had distracted her while driving, and that she was not impaired by alcohol (even though she was above the legal limit).  The Prosecutor agreed to dismiss the DUI in exchange for a plea to a Reckless Driving with zero days in jail.

State v. Mr. H (DMC No. 7409)

DUI (.082 BAC) REDUCED to RECKLESS DRIVING with ZERO DAYS in JAIL /HIT and RUN DISMISSED – State v. Mr. H. (DMC No. 7409) (Florence City Court TR2007-0189): Florence Police received a call regarding a Hit and Run into an APS light pole.  Officers found Mr. H. behind the wheel of his car along Highway 79.  They had discovered he had been drinking, and they eventually arrested him for DUI and took him to the station.  He provided a .082 BAC on the breath test.  Due to Actual Physical Control (APC) issues, and the fact they could not prove he was the one who was actually driving the vehicle, we were able to convince the Prosecutor to dismiss the DUI and Hit and Run in exchange for a Reckless Driving charge and zero days in jail.

State v. Ms. A. (DMC No. 10349)

DUI (.081 BAC) REDUCED to RECKLESS DRIVING with ZERO DAYS in JAIL – State v. Ms. A. (DMC No. 10349) (Prescott Valley Magistrate Court TR2011-0789): Ms. A. was at Glassford Hill Road and Spouse Road in Prescott Valley, Arizona when she pulled over in order to allow her husband to vomit outside of their vehicle.  An officer pulled up and got into a verbal altercation with her husband.  Her husband was arrested for Disorderly Conduct, and then she was also cited for DUI.  She eventually provided a .090 breath test with a .081 blood test BAC.  Because she was not seen actually driving, only sitting behind the wheel with the engine running, we convinced the Prosecutor to dismiss the DUI in exchange for a Reckless Driving with zero days in jail.

State v. Mr. B. (DMC No. 7282)

REDUCED | DUI State v. Mr. B. (DMC No. 7282) (McDowell Mountain Justice Court No. TR 2007-110596): REDUCED to Reckless Driving –  Mr. B was observed travelling eastbound on the 101 Freeway at 75mph and was supposedly driving erratically. An officer stopped him and conducted Field Sobriety Tests. He then arrested him for DUI and took him to the station where he produced a .080 breath alcohol reading. Due to the low reading, and the fact that there was no egregious driving, we were able to secure a plea to a Reckless Driving which involved no days in jail.

REDUCED | DUI (.079 BAC) (0301104CR): Mr. L. was stopped by police in the City of Scottsdale. He performed extremely well on Field Sobriety Tests, and he provided a blood sample with revealed a .079 BAC. Due to “No reasonable likelihood of conviction,” Mr. L. secured a Reckless Driving plea with zero days in jail.

REDUCED | DUI (.071 BAC) and DRIVING WHILE LICENSE SUSPENDED REDUCED to UNDERAGE DRINK and DRIVE/RECKLESS with ZERO DAYS JAIL – State v. Ms. C. (DMC No. 5527) (Maricopa County Juvenile Court JV164073): Ms. C. was pulled over for failing to stop completely at a red light.  She was subsequently arrested for DUI and placed under arrest.  Because there were issues with reading her, her Miranda rights, and possibly “no probable cause” for arrest, we were able to have the case reduced from DUI/ suspended license down to an underage drink and drive/reckless with zero days in jail.  The case was also kept in Juvenile Court and did not appear on her adult record.

State v. Mr. M. (DMC No. 7228)

REDUCED | DUI – State v. Mr. M. (DMC No. 7228) (University Lakes Justice Court No. TR2007-107320): Mr. M was observed making a wide right turn on University Dr. off of Rural Rd. After being stopped, the officer had Mr. H perform Field Sobriety Tests and claimed that he was impaired. Once he was given a breath test it revealed that he was only a .071 Breath Alcohol Content. We were able to convince the Prosecutor that they would lose at trial, and they extended a 0 days in jail Reckless Driving offer.

State v. Mr. H (DMC No.)

REDUCED | DUI (.065 BAC) (Gilbert Municipal Court No. 2007-TR-0000487-DU): Mr. H. was seen driving with one headlight and was subsequently stopped by a Gilbert Police Officer. He was arrested for DUI and underage Drinking and Driving, and provided a blood test which showed a .065 blood alcohol content. However, the officer claimed that Mr. H. was under the influence of marijuana, and had a Drug Recognition Evaluation performed on him. The drug test came back with “No drugs detected.” We were able to negotiate a Reckless Driving plea with zero days jail where not only the DUI was dismissed, but also the Underage Drinking and Driving (which would have cost Mr. H. his license until his 21st birthday).
