REDUCED | EXTREME DUI (.156 BAC) State vs. Mr. H. (DMC No. 9823) (Phoenix City Court No. 4272304): Mr. H. was stopped by Phoenix PD after they used a radar gun and clocked him doing 49 in a 35. They then paced him with their vehicle travelling 64 m.p.h. Once he was stopped, they claimed that they he performed poorly on field sobriety test and he provided a blood test which would reveal the .156 blood alcohol concentration. Due to issues with the radar gun and with the blood testing device, we convinced the prosecutor to dismiss the extreme DUI, which would have required 30 days in jail, and instead offer a plea to a regular DUI with 1 day in jail.
