SENTENCED MODIFIED to ALLOW WORK FURLOUGH/AGGRAVATED ASSAULT with a GUN – State v. Mr. W. (DMC No. 5451) (Maricopa County Superior Court CR2004-041733): Mr. W. got in an argument with his ex-girlfriend’s new boyfriend, and he subsequently pulled a gun and pointed it at him. He was originally charged with aggravated assault with a dangerous weapon, which was reduced to a “non-dangerous” aggravated assault with probation and 1 year of jail time. He was originally not allowed to be in the work furlough program due to the dangerousness of his offense. We were able to have the sentenced modified, and the Judge ordered him into work furlough, thereby saving Mr. W.’s job.
