Can a will be contested in Arizona?
Yes. Under Arizona law, a will may be contested on grounds such as “lack of testamentary capacity”, undue influence, fraud, forgery, or improper execution. What qualifies as undue influence in an estate dispute?
“Undue influence” occurs when a person exerts improper pressure on a Testator, thereby overcoming their free will and resulting in an Estate Plan that reflects the influencer’s interests, rather than the Decedent’s intent. This kind of influence frequently involves caregivers, spouses, advisors, or individuals with access to the Decedent during periods of vulnerability.
What are a trustee’s fiduciary duties under Arizona law?
Trustees in Arizona owe strict “Fiduciary Duties”, including the duties of Loyalty, Impartiality, Prudence, and Transparency. They must manage trust assets responsibly, avoid conflicts of interest, provide accurate accountings, and act in the “Best Interest of the Beneficiaries.” Breaches of these duties can result in personal liability and removal.
Can a trustee or personal representative be removed?
Yes. Arizona Courts may remove a Trustee or Personal Representative for breaching fiduciary duty, mismanaging assets, failing to provide required disclosures, conflicts of interest, or incapacity.
