State v. Ms. G (DMC No. 16723) – Theft of Opioids and Abuse of Opioids (Unprofessional Nursing Conduct) – Appeal Granted, and License Revocation Reduced to Probation (with No License Suspension) – After a Arizona Board of Nursing Hearing Held – Arizona Board of Nursing (RN No. 1XXXX4)

Ms. G was a Mobile Nurse who would go to elderly patient’s homes in order to treat them. She was ultimately terminated by her employer, and they made various allegations against her. The Arizona Board of Nursing became involved, and they Revoked Ms. G’s Nursing License. That is when she secured the services of DM Cantor. 

We set her case for a Hearing in front of the Arizona Board of Nursing and the Office of Administrative Hearings. During this Hearing, we exposed all of the flaws in the investigation. The Board of Nursing did almost no investigation, and they left that task to Ms. G’s former employer and their nurses. One of their allegations was that Ms. G went on a very specific day to a patient’s house, and stole opioid medication. We were able to prove without a doubt that she was not even in town on that day. In addition, one witness stated that nurse was five foot six inches tall, and Ms. G is five feet ten inches tall. The elderly were also given pictures of Ms. G two days prior to the hearing to try and identify her. 

Another witness who claimed to be a patient and his wife that Ms. G had met with them while taking medication. Ms. G had never ever been to their house, and was not assigned to treat them. In fact, the date she was supposedly went to their house was after she was terminated from employment by the company. Again, these witnesses  were manipulated by Ms. G’s former employer. This is most evident when the wife of the patient said that the nurse’s name was “Chrissy”. Ms. G’s name was not Chrissy, however, there was another employee who was a nurse at her former job who was named “Chrissy”, and was five foot six. 

After an extensive Hearing, the Office of Administrative Hearings and the Arizona Board of Nursing Reduced the License Revocation to a “Simple Probation” (No Suspension). Ms. G has continued to successfully work as a nurse serving the people of Arizona.
