State v. Dr. B (DMC No. 16578) – Felony Possession of Dangerous Drugs (Cocaine) and Felony Possession of Marijuana – Medical License Not Suspended After Arizona Medical Board Hearing (with Requirement of Full Participation of Physician Health Program) – Arizona Medical Board (Case No. MD-19-1XXXA)
Dr. B was traveling approximately 10 o’clock at night in Arizona on the I-10. An Officer claimed that he saw him traveling 84 miles per hour in a 75 mile per hour zone, and that his window tint was Illegal. He was subsequently stopped, and the Officer noticed an odor of Marijuana. When the Officer conducted a Search of the car, he also found a baggy which contained a small amount of Cocaine, along with a baggy of Marijuana. Dr. B was arrested, and Charged with Felony Possession of Cocaine and Felony Possession of Marijuana. It was at that time he secured the services of DM Cantor.
In addition to defending the initial Charges against Dr. B, we also handled his issues with the Arizona Medical Board. The first thing we did was have Dr. B Self-Report the Arrest, then we began dealing with the Board. We put together a statement of all the facts involved, along with a copy of the Police Report, and provided it to the Board. We also had Dr. B attend Counseling and submit his records. At the Hearing, the Medical Board made the decision to Not Suspend Dr. B’s License, if he would attend Classes in the Physician’s Assistance Program. Dr. B Successfully Completed all Classes, and he is a productive physician today.
