I tell my clients that truth is will set us free. I think video of the encounters will help both sides. Video can cut both ways, but I can help clients with truth better than falsity. I have clients who tell me nearly outlandish stories about what happened and then I watch video that contradicts them. I save time for my other clients when I can see that a certain client should begin damage control and take a plea. At the same time, I have read police reports that appear to make things awfully grim for a client only to view video and see many actions that help a motion to suppress despite the violation of law by the client. The case is 20 years old. The evidence, whatever may remain, is 20 years old, and could be lost. Memories are 20 years old. Credibility fades as time goes on. Without the defendant admitting that he was at the scene, his "accomplice" would have to testify and be believed by the jury. After 20 years, and without the use of his confession, it is unlikely that if the case is retried, that the prosecution could successfully prove the defendant's guilt beyond a reasonable doubt.
